CHULC REPORT CHANNEL, EPE


In compliance with the provisions of Decree-Law no. 109-E/2021, of 9 December, which creates the National Anti-Corruption Mechanism (MENAC) and establishes the General Regime for the Prevention of Corruption (RGPC) and Law no. 93/2021, of December 20, which approved the General Regime for the Protection of Infringement Whistleblowers regarding the protection of persons, CHULC ensures the availability of a Whistleblower Channel. Channel guarantees the confidentiality of the identity and anonymity of whistleblowers, as well as third parties

The Channel ensures the security conditions for employees/suppliers/users or citizens in general all rights related to the protection of their personal data, being ensured at all stages of the process, namely in the collection, analysis and forwarding.

The data collected are mandatory or optional, being identified in the various fields to fill in the mandatory or not to fill in the field and will be kept in the strictly necessary time for the purpose for which they are intended, and then deleted.

The metadata will be automatically deleted in the Whistleblower Channel. data collection, evaluates the complaint, communicates with the author of the same and makes its referral, according to the areas of intervention, to the competent authorities with a view to its analysis and treatment, in accordance with the legally applicable investigation processes.This Channel allows you to report irregular practices of which you are aware of or that you may confront in the context of your personal or professional relationship with CHULC, particularly associated with phenomena of corruption, financial deviations, moral and sexual harassment fraud, incompatibilities, conflict of interest, (a) the act or omission contrary to European Union rules relating
to:
- Public procurement, - Financial services, products and markets, prevention of money laundering, financing of terrorism,
- Product security and compliance, - Transport security,
- environmental protection,
- radiation protection and nuclear safety,
- food and feed safety, animal health and welfare, - Public health,
- consumer protection,
- protection of privacy and personal data and security of the network and information systems; (
b) the contrary act or omission affecting the financial interests of the European Union; (
c) the act or omission contrary to the rules of the internal market, including the rules on competition and state aid, as well as the rules on corporate taxation;
) Violent crime, especially violent and highly organized, as well as the crimes provided for in paragraph 1 of article 1 of Law no. 5/2002 of 11 January https://diariodarepublica.pt/dr/detalhe/lei/5-2002-583017;
e) The act or omission that contradicts the end of the rules or norms covered by subparagraphs a) to c)
Are also considered the complaints of:
- Acts of corruption and related offenses (Article 8 of the General Regime for the Prevention of Corruption); - Moral harassment and/or sexual and Discrimination.

Protection conferred on the whistleblower to natural persons who report an infringement on the basis of information obtained in the course of their professional activity, namely:
- Employees of CHULC, EPE;
- Service providers, contractors, subcontractors and suppliers, as well as any persons acting under their supervision and direction;
- Persons belonging to administrative, supervisory or supervisory bodies; - Volunteers and trainees paid or unpaid.

It shall not preclude the consideration of a natural person as a whistleblower the fact that the complaint of an infringement is based on information obtained in a ceased professional relationship, as well as during the recruitment process or during another phase of pre-contractual negotiation of a professional relationship whether constituted or not constituted., these have their own channel for

After submitting your report, an access code will be generated, which you must keep securely. It will be with this code that you will be able to consult and monitor the state of your process, as well as make new communications or provide clarifications.
