What is 
the Whistleblower channel?
 

Tiko makes this channel available to communicate or report on any action or omission that may constitute an administrative, criminal, or European Union law offense, in accordance with the provisions of current law. This channel can also be used to submit communications regarding a violation of our Code of Conduct (published and accessible within the Staff Manual on drive), labour, safety, health, and anti-harassment regulations, Human Resources policies, as well as any of the internal regulations communicated and in force in the Company.



How to make a report? 

The tool is very intuitive and easy to use. To begin, you must click on the link for this purpose located on our website with the name Whistleblower channel. You can make a communication, whenever there are reasonable reasons for doing so, confidentially, indicating your name and contact information, or completely anonymously. In addition, the report can be both written and verbal, by recording voice or by distorting the voice in said recording.


How is it processed?

Once your communication has been registered through this system, the people responsible for the channel will proceed to open an investigation procedure, within a maximum period of 7 days. The response or decision made to it will be communicated to you through this channel within a maximum period of 7 days. You will receive an alert at the assigned email address informing you of any relevant information in the process. Communications will always be through the platform to ensure anonymity and confidentiality. 

In what time frame will the relevant investigations be carried out? 
In accordance with current legislation, a maximum period of 3 months is available from the acknowledgment of receipt of the initial communication, unless there are legal causes that require a longer period of time. In that case, we will have an additional 3 months.


How can I access it to check the status of my communication or carry out other management? 
Once the initial communication has been made, you can access the tool using your access credentials at the web address enabled for this purpose. Only you can access it with the personal and non-transferable passwords that are automatically provided at the beginning of the communication.


What guarantees does the informant have? 

The informant will have the following guarantees: 
Sole recipient: Tiko has a specific work team for the management of this channel as well as, where appropriate, with investigation teams specifically designated for the management of each case. Nobody from the management team will have access to this information.
Protected identity with the utmost confidentiality (except for legal/judicial obligation) and anonymity, if you choose to do so. 
- Protection against any type of retaliation because of the complaint/consultation/report carried out. 
- Processing of personal data in a confidential manner
- Use of the information provided in a complaint/report only for legitimate purposes in relation to the investigation being initiated. 

How will my data be processed? 
Tiko will process the personal data provided to process and investigate, in a confidential manner, communications sent through the channel for possible breaches of our Code of Conduct (published and accessible within the Staff Manual on drive), labour, safety, health, and anti-harassment regulations, Human Resources policies, as well as any of the internal regulations communicated and in force in the Company.

This treatment is based on compliance with a legal obligation, contained in European regulations on the protection of the informant.


In the course of an investigation, it may be necessary to share the facts reported with third parties (external advisors, competent authorities, etc.). In any case, confidentiality and data protection and, where appropriate, the anonymity of the informant will be adequately guaranteed.


Personal data will be kept for the time strictly necessary to carry out an adequate management of the case and, even then, duly blocked, if liability or legal obligations may arise for Tiko. In any case, the data will be kept following the storage periods established in the applicable regulations.


At any time, you can exercise your rights of access, rectification, opposition, portability and limitation of treatment through the platform.
