The Complaints Portal of the Open University (UAb) is intended only for the communication of complaints covered by:
Practice of discrimination and harassment (moral and/or sexual);
Application of the General Regime for the Protection of Whistleblowers of Infringements (RGPDI), approved by Law nÂș 93/2021, of 20 December, which transposed into the national legal order Directive (EU) 2019/1937 of the European Parliament and of the Council, of 23 October 2019, on the protection of persons who report violations of European Union law;
Application of the General Regime for the Prevention of Corruption (RGPC), approved by Decree-Law no. 109-E/2021, of 9 December.
Complaints on topics not covered by the UAb Whistleblower Portal, must be made through the UAb Portal (https://portal.uab.pt).
UAb's Whistleblower Portal is impartial and independent, receiving and processing all complaints with secrecy, confidentiality, security and rigor.
When submitting a complaint, a confidential access code is automatically generated, which allows the consultation and monitoring of the process, making new communications or providing clarifications. All communications about the status of the complaint, requests for clarification and/or sending additional information are made through this Portal, using the access code generated and which must be stored securely.
Upon submission of the complaint, you will receive, within seven days, a notification indicating its receipt, relevant information on the requirements, competent authorities and admissibility to file an external complaint.
Users of the UAb Whistleblower Portal are protected by law.
Any type of retaliation is prohibited and anonymity and/or confidentiality is ensured when desired by the whistleblower. The protection granted is extended to third parties who assist or are connected to the whistleblower. The communication and processing of personal data is used exclusively for the legal purposes provided for the complaint channel, in strict compliance with the provisions of the General Data Protection Regulation, approved by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, Law no. 58/2019, of 8 August and in the Privacy Policy.
The security of the information received on the UAb Whistleblower Portal is guaranteed, and its access is restricted only to persons authorized by the University.
Complaints received shall be maintained and maintained for a minimum period of five years and, regardless of that period, during the pending of related judicial, administrative or disciplinary proceedings.
Any complaint lodged must be made in the spirit of truthfulness of the facts. The misuse and/or the provision of false statements are serious acts that compromise the purpose of the reporting channel, being punished under legal terms.
Before making a complaint, it is recommended to carefully read Law no. 93/2021, of December 20 and other applicable legislation.
