WHistleblower CHANNEL
Law no. 93/2021, of 20 December, established the General Regime for the Protection of Whistleblowers of Infractions (RGPDI), transposing Directive (EU) 2019/1937 of the European Parliament and of the Council, of 23 October 2019, on the protection of persons who report violations of European Union law.
This regime aims to ensure the protection of the natural person who denounces or publicly discloses an offence committed, that is being committed or whose commission can be reasonably foreseen, as well as the attempt to concealment, based on information obtained within the scope of his professional activity.
On the other hand, Resolution of the Council of Ministers No. 37/2021, of April 6, approved the National Strategy to Combat Corruption 2020-2024 (ENCC), materialized in the general regime for the prevention of corruption and related infractions, approved in an annex to Decree-Law no. 109-E/2021, of 9 December (GGPC), which determines, in its article 8, the need to create internal reporting channels to follow up on reports of acts of corruption and related infringements.
The Imprensa Nacional-Casa da Moeda (INCM) guides its performance “for compliance with legal and ethically accepted rules” and by “international recommendations that attach increasing importance to the form of corporate governance”.
By providing this channel, it is sought to ensure that all those related to INCM interact with an entity committed to strict compliance with legislation and compliance with high standards of business ethics.
INCM intends to allow the reporting, by its workers or third parties, of any situations that violate the rules on which the principles of Business Ethics are based, ensuring that any founded and good faith complaint is presented in a safe and effective way, with the guarantee that whistleblowers will be protected against any type of retaliation and that the entire process will be conducted confidentially.
Complaints may be made confidentially, indicating the name and contact information, or, if you prefer, completely anonymously.
All consultation requests are handled confidentially and securely by INCM.
The complaints received by INCM are treated in accordance with the provisions of Law no. 58/2019, of 8 August, which ensures the implementation, in the national legal order, of Regulation (EU) 2016/679 of the Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and the free movement of such data.
By submitting a complaint, INCM assumes that the whistleblower has become aware of INCM's Privacy Policy and that it agrees to the processing of data.
